Agreement
Welcome to Levelation. These Terms of Service (the “Terms”) explain the rules for using the Levelation Platform (the “Platform,” “Service,” or “Levelation”) operated by Levelation International (“Levelation,” “we,” “us,” or “our”). By creating an account, purchasing a membership, taking an assessment, enrolling in a course, or otherwise using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.
These Terms, together with our Privacy & Cookie Policy and any order page, plan description, or supplemental terms we present at the point of purchase, form the entire agreement between you and Levelation regarding the Platform. If a supplemental term conflicts with these Terms for a specific feature, the supplemental term controls for that feature. If you use the Platform on behalf of an organization, you represent that you are authorized to bind that organization, and “you” includes that organization.

Levelation offers, or will offer as the member platform launches:
We may add, change, or discontinue features. We will give reasonable notice of material changes that adversely affect a paid feature you are actively using (see Section 19).
You must be at least 18 years old to enter into these Terms and hold an account on your own behalf. We also welcome learners who are 16 or 17, but only where a parent or legal guardian reviews and accepts these Terms on the minor’s behalf and supervises their use; in that case the parent or guardian is responsible for the minor’s compliance with these Terms. The Platform is not intended for children under 16, consistent with our Privacy & Cookie Policy. If your jurisdiction permits younger participants in a specific program, we will obtain verifiable parental consent before enrollment.
If you join through an employer, institution, or cohort that purchased your membership, your use may also be subject to that organization’s agreement with us and its own policies.
You agree to provide accurate information, to keep it current, and to keep your credentials confidential. You are responsible for activity under your account. Tell us promptly at legal@levelation.org if you suspect unauthorized use. We may offer passkeys, multi-factor authentication, or third-party sign-in (for example, Google or Microsoft); using those is subject to the provider’s terms. You may not share an individual account, sell or transfer it, or let others use it, except where an organization administers seats it has purchased.
Some features require a paid membership. Prices, billing periods, and what each tier includes are shown at the point of purchase. Payments are processed by our PCI-DSS-compliant payment processor (Whop) on its hosted checkout; we never receive or store your full card number (see Privacy Policy §1.7).
When you start a paid membership, you authorize us and our payment processor to charge your payment method the then-current fee, plus applicable taxes, for the billing period you select. Paid memberships renew automatically at the end of each period at the then-current price until you cancel. We will tell you the renewal date and amount at purchase and, where required by law, send a renewal reminder.
Stated prices may exclude sales, use, VAT, GST, or similar taxes, which we add where required. You are responsible for those taxes other than taxes on our net income.
We may change prices. A price change applies to your next renewal after we give you advance notice, and you may cancel before it takes effect if you do not accept the new price.
If a charge fails, we may retry it and may suspend or downgrade paid features until payment succeeds.
You can cancel at any time from your account settings (or by emailing legal@levelation.org). When you cancel, your paid access continues through the end of the billing period you have already paid for, and your membership does not renew after that.
We do not provide prorated or partial refunds for the unused portion of a billing period, except where a refund is required by applicable law or expressly offered at the point of purchase. Annual plans follow the same rule. Nothing in this Section limits any statutory cancellation or “cooling-off” right you may have under the law of the place you live (see Section 20).
We may offer free tiers, trials, scholarships, sliding-scale pricing, or organization-sponsored seats. We may set eligibility rules and limits for these, and we may modify or end them. Unless stated otherwise, a free trial converts to a paid membership at the end of the trial unless you cancel beforehand, and we will make the trial terms clear before you start.
Our assessment and AI features produce results from the inputs you provide and from public frameworks we map against. As described in our Privacy & Cookie Policy (§3), this profiling is advisory: it does not by itself deny services, set prices, or determine employment, credit, housing, or healthcare outcomes, and we do not use AI to make consequential decisions about you without human involvement. AI outputs can be inaccurate or incomplete; you are responsible for how you use them. We do not permit our AI providers to train on your content.
You agree not to, and not to help anyone else:
We may investigate and respond to suspected violations, including by removing content and suspending accounts (see Section 18).
“Your Content” means the assessment responses, profile information, messages, posts, files, and other materials you submit. You keep all ownership of Your Content. You grant Levelation a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, and display Your Content only as needed to operate, secure, support, and improve the Platform and to provide the features you request.
If you post in community spaces or other shared areas, you grant other permitted members the access needed to view and interact with what you chose to share there. Feedback you send us (ideas, suggestions) is given freely, and we may use it without obligation to you. You are responsible for keeping your own copies of Your Content; deletion and retention are described in Section 18 and the Privacy Policy.
The Platform, including the Levelation assessment system, scoring engine, course materials, software, design, text, graphics, and the “Levelation” name and logo, is owned by Levelation International or its licensors and is protected by intellectual-property laws. Public frameworks we map against remain the property of their respective owners; our particular implementations, content, and compilations are ours. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Platform for your own non-commercial use (or, for organizational customers, for the internal use described in your order), subject to these Terms. All rights not expressly granted are reserved.
The Platform integrates and links to third-party services (for example, payment, analytics, sign-in, and AI providers listed in our Privacy Policy). We do not control those services, and your use of them is subject to their terms and privacy policies. If you obtain the mobile app from the Apple App Store or Google Play, that store’s terms also apply, and where required those stores are intended third-party beneficiaries of these Terms with respect to the app.
Our collection and use of personal information is described in our Privacy & Cookie Policy, which is part of these Terms. By using the Platform you acknowledge that policy, including our practices on assessment and AI data, international transfers, retention, and your privacy rights.
Except where the law does not allow it, the Platform is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure, or that any result, score, insight, or recommendation will achieve a particular outcome. See Section 9 regarding the advisory nature of assessments and AI features. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
To the fullest extent permitted by law, Levelation and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or relating to your use of the Platform. To the fullest extent permitted by law, our total liability for all claims relating to the Platform in any 12-month period will not exceed the greater of (a) the amount you paid us for the Platform in that period, or (b) US$100.
To the extent permitted by law, you agree to defend, indemnify, and hold Levelation harmless from claims, losses, and reasonable expenses (including reasonable legal fees) arising from your misuse of the Platform, your violation of these Terms or the law, or content you submit. We will notify you of the claim, let you control the defense of claims arising solely from your conduct (with our right to participate), and cooperate reasonably. This Section does not apply to the extent a claim arises from our own wrongdoing.
You may stop using the Platform and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or to protect the Platform or other users; where practical and lawful, we will give notice and an opportunity to cure. On termination, your right to use the Platform ends and we may delete or deactivate your account.
We may update these Terms as the Platform evolves. For material changes, we will post the updated Terms with a new “last updated” date and, where the change adversely affects you in a significant way, give reasonable advance notice in the Platform or by email before it takes effect. Changes are not retroactive. Continuing to use the Platform after a change takes effect means you accept the updated Terms; if you do not agree, stop using the Platform and, if you have a paid membership, you may cancel under Section 7.
These Terms and any dispute relating to them or the Platform are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You and Levelation agree to the exclusive jurisdiction of the state and federal courts located in Alameda County, California, and waive any objection to venue there. We do not require binding arbitration, and there is no class-action waiver in these Terms.
We encourage you to contact legal@levelation.org first so we can try to resolve any concern informally.
Entire agreement. These Terms and the documents they incorporate are the entire agreement between you and Levelation about the Platform and replace any prior agreement on that subject.
Severability. If a provision is held unenforceable, the rest remains in effect, and the unenforceable provision is limited to the minimum extent necessary.
No waiver. Our not enforcing a provision is not a waiver of our right to enforce it later.
Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control.
Notices. We may give notice by posting in the Platform or emailing the address on your account; you give notice to us at legal@levelation.org.
Export and sanctions. You represent that you are not barred from using the Platform under applicable export-control or sanctions laws.
Language. If we provide a translation of these Terms, the English version governs if there is a conflict.
