Terms and Conditions for Levelation International
Effective Date: April 12, 2026
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“you” or “User”) and Levelation International (“Levelation,” “we,” “us,” or “our”), a nonprofit organization organized under Section 501(c)(3) of the Internal Revenue Code, governing your access to and use of our websites, applications, programs, leadership initiatives, membership platforms, and related services (collectively, the “Services”).
By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Services.
1. Nature and Scope of Services
Levelation provides educational, developmental, and leadership-oriented services designed to support personal resilience, leadership development, and systems-level transformation. Our work integrates neuroscience-informed practices, lived experience, and multi-level systems frameworks across individual, relational, organizational, and societal contexts.
The Services may include leadership programs, executive cohorts, coaching and advisory services, organizational consulting, educational trainings, research-informed tools and assessments, membership and networking platforms, grantmaking initiatives, and digital tools that support reflection, workflow, and resilience practices.
All Services are provided for educational and developmental purposes in furtherance of Levelation’s nonprofit mission and do not constitute regulated professional services.
2. No Medical, Clinical, or Professional Advice; Referrals
The Services are not intended to constitute medical, psychological, psychiatric, legal, financial, or other licensed professional advice. Levelation is not a licensed healthcare or clinical provider, and your use of the Services does not establish any therapist-client, physician-patient, or other licensed professional relationship.
Levelation’s programs may involve reflective processes, leadership development, and discussions related to personal and emotional experiences. However, such activities are educational and developmental in nature and are not a substitute for clinical care.
If, in the course of participation, Levelation reasonably determines that your needs extend beyond the scope of coaching, education, or leadership development, Levelation may, at its discretion, suggest or refer you to licensed professionals or clinical partners. Any such referrals are provided solely as a resource. Levelation does not control, supervise, or guarantee the services of any referred provider and disclaims all liability arising from such third-party services.
You acknowledge that you are solely responsible for your health, wellbeing, and decision-making, and you agree to seek appropriate licensed care when needed.
3. Eligibility and Acceptable Use
You represent that you are at least eighteen years of age or are accessing the Services with appropriate parental or guardian consent. You agree to use the Services in compliance with all applicable laws and in a manner consistent with Levelation’s mission and community standards.
You shall not misuse the Services, attempt to gain unauthorized access to systems or data, interfere with platform functionality, misrepresent your identity or affiliation, or engage in conduct that is harmful, disruptive, or inappropriate in a leadership or community setting.
4. Accounts, Membership, and Program Participation
Certain Services may require registration, membership enrollment, or execution of separate agreements. You agree to provide accurate and complete information and to maintain the confidentiality of your account credentials. You are responsible for all activities conducted under your account.
Participation in specific programs, including leadership cohorts, consulting engagements, or grant-funded initiatives, may be subject to additional terms and conditions set forth in separate agreements. In the event of a conflict between these Terms and any program-specific agreement, the program-specific agreement shall govern with respect to that program.
Levelation reserves the right to suspend or terminate access to any Service or program at its discretion, including in cases of violation of these Terms.
5. Payments, Donations, and Financial Terms
Certain Services may require payment of fees, and Levelation may also accept voluntary donations. All payments are processed through third-party providers, and you agree to provide accurate and authorized payment information.
Unless otherwise expressly stated in writing, fees are non-refundable. Donations are voluntary and may be tax-deductible to the extent permitted by law. Levelation does not provide tax advice, and you are responsible for consulting your own tax advisor regarding deductibility.
6. Grantmaking and Funding
Levelation may administer grantmaking or funding programs in furtherance of its mission. All grant decisions are made at Levelation’s sole discretion and are subject to eligibility criteria, review processes, and applicable legal requirements. Submission of an application does not guarantee funding.
7. Intellectual Property
All content, materials, frameworks, methodologies, and tools provided through the Services are the property of Levelation or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use such materials solely for personal or internal organizational purposes consistent with these Terms.
You may not reproduce, distribute, modify, or create derivative works from Levelation’s content without prior written consent.
8. Third-Party Services
Levelation may utilize third-party service providers to support delivery of the Services. This includes, without limitation, tools provided by Got This, Inc., an independent company. Got This operates separately from Levelation and maintains its own terms and privacy policies.
Levelation is not responsible for the acts, omissions, or policies of third-party providers, and your use of such services is governed by their respective terms.
9. User Content and Community Participation
You may choose to submit or share content in connection with the Services, including reflections, responses, or organizational information. You retain ownership of your content but grant Levelation a limited license to use such content for the purpose of providing and improving the Services.
You acknowledge that participation in group programs or community environments may involve sharing information with others and that Levelation cannot guarantee the confidentiality of information disclosed to other participants.
10. Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Levelation disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Levelation does not guarantee any specific outcomes from participation in its programs, including leadership development, coaching, consulting, or other Services.
11. Limitation of Liability
To the maximum extent permitted by law, Levelation shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Services, even if advised of the possibility of such damages.
In no event shall Levelation’s total cumulative liability exceed the amount paid by you, if any, for the Services giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Levelation and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
13. Dispute Resolution and Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good faith informal discussions.
If such dispute cannot be resolved informally, it shall be resolved exclusively through final and binding arbitration administered by a recognized arbitration provider in accordance with its applicable rules. The arbitration shall take place in the State of California, unless otherwise mutually agreed.
You and Levelation agree that arbitration shall be conducted on an individual basis and not as part of any class, collective, or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction for matters involving intellectual property rights or unauthorized access to systems.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California and applicable United States federal law, without regard to conflict of law principles.
15. Termination
Levelation reserves the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms or conduct inconsistent with Levelation’s mission or community standards.
16. Modifications to Terms
Levelation may revise these Terms from time to time. Updated Terms will be posted with a revised effective date. Your continued use of the Services constitutes acceptance of the revised Terms.
17. Entire Agreement
These Terms, together with any applicable program-specific agreements, constitute the entire agreement between you and Levelation regarding the Services and supersede all prior agreements or understandings.
